Charges involving computer crimes are becoming more and more common.  Police and prosecutors generally charge two types of crimes under the computer crimes law, and these are separate from charges of child pornography.

Child Pornography Literature

A person commits a class B felony, and may be sent to the New Hampshire State Prison for up to seven (7) years, if that person knowingly:

  • Compiles, enters into, or transmits by way of a computer
  • Makes, prints, publishes, or reproduces by other computerized means
  • Causes or allows to be entered into or transmitted by means of computer
  • Buys, sells, receives, exchanges, or disseminates by means of a computer

Any

  • Notice
  • Statement
  • Advertisement

Of any minor’s

  • Name
  • Telephone number
  • Place of residence
  • Physical characteristics
  • Other descriptive  or identifying information

For purposes of facilitating, encouraging, offering, or soliciting sexual conduct of or with any child, or the visual depiction of such conduct.

Certain Uses of Computer Services Prohibited

The more serious, and more often charged crime, is called “Certain Uses of Computer Services Prohibited.”  Essentially, a person charged with this crime is accused of using a computer to solicit a person he believes is a child for a sexual act.

A person charged with this crime is accused of knowingly using a computer on-line service, internet service, or local bulletin board service to seduce, solicit, lure, or entice a child or another person believed by that person to be a child, to commit any of the following:

  • Sexual assault
  • Indecent exposure
  • Lewdness
  • Endangering the welfare of a child

A conviction for this offense will be for a class A felony if that person believed the child was under 13 years old, otherwise it is a class B felony.
