Robbery

Someone commits a robbery if he uses or threatens to use physical force on another person while committing a theft.  Robbery is an incredibly serious charge, and you need an experienced and effective criminal defense attorney.  Robbery can either be a class A or B felony.  It is a class B felony unless the person is armed with a deadly weapon, appears to be armed with a deadly weapon, or inflicts or attempts to inflict death or serious bodily injury on the person.

Assault

Under New Hampshire law, there are many different kinds of assault allegations. 

First Degree Assault

The first and most serious is first degree assault.  First degree assault is a class A felony.  A person commits this crime when he purposely causes serious bodily injury to another person, purposely or knowingly causes bodily injury to another person with a deadly weapon.

Domestic Violence

A charge of assault involving domestic violence is a very serious accusation and a very common criminal charge.  It as well often includes proceedings involving protective orders (restraining orders).

A person commits a crime of domestic violence if he commits one or more of the following offenses against a family or household member, or a current or former sexual or intimate partner, and where the conduct constitutes a credible threat to the other person’s safety:

  • Criminal Threatening
  • Sexual Assault
  • Interference with Freedom
  • Destruction of Property
  • Unauthorized Entry
  • Harassment

Homicide (Murder, Manslaughter, Negligent Homicide)

Murder is the most serious crime under the law. 

First Degree Murder

A person commits first degree murder if he purposely causes the death of another person or knowingly causes the death of another person during the commission of certain crimes.  A person convicted of first degree murder will be sentenced to the New Hampshire State Prison for life without parole.

Larceny / Theft

The crime of theft can take many different forms under New Hampshire law. 

Theft by Unauthorized Taking

The most common charge of theft is theft by unauthorized taking.  A person commits this crime if he obtains or exercises unauthorized control over the property of another with the purpose to deprive him of that property. 

Drug Offenses

A drug offense can range from a violation-level offense to a sentence of 15 to 30 to life imprisonment at the New Hampshire State Prison.  Sentences for drug offenses when a person has a prior drug conviction will be much more severe.  Generally speaking, a person is guilty of a drug offense if he manufactures, sells, transports or possesses with the intent to sell, or simply possesses a controlled drug, its analog, or something he purports to be a controlled drug.

Burglary

Burglary

A person commits the crime of burglary if he enters a building or occupied structure with the purpose to commit a crime therein, unless at the time the premises is open to the public or the person is invited inside.

Stalking

A person can commit the crime of stalking several ways.  He may do so if he purposely, knowingly, or recklessly engages in a course of conduct directed at a specific person that would cause a reasonable person to fear for his or her personal safety or the safety of a member of that person’s immediate family, and the person is actually placed in such fear.

A person also commits stalking if he purposely or knowingly engages in a course of conduct targeted at a specific individual, which the person knows will place that individual in fear for his or her personal safety or the safety of a member that person’s immediate family.

Kidnapping

A person commits the crime of kidnapping if he knowingly confines another person under his control with a purpose to:

  • Hold him for ransom or as a hostage
  • Avoid apprehension by a law enforcement official
  • Terrorize him or some other person
  • Commit an offense against another person

Fraud

There are three (3) types of fraud crimes that are often charged by police and prosecutors.  They are:  Forgery, Issuing Bad Checks, and Fraudulent Use of a Credit Card.  Fraud crimes can be felonies or misdemeanors, and oftentimes are accompanied with jail time and restitution.

Computer Crimes

Charges involving computer crimes are becoming more and more common.  Police and prosecutors generally charge two types of crimes under the computer crimes law, and these are separate from charges of child pornography.

Child Pornography

Another computer-related crime is possession and/or distribution of child pornography.  Police and prosecutors are pursuing these cases more aggressively in recent years, and they are seeking higher jail and prison sentences for people convicted of this crime.

Sexual Assault

Charges of sexual assault can ruin a person’s life.  Just the allegation of it can cast a shadow over a person’s character and reputation.  A conviction for such a charge can result in a prison and registering as a sex offender.  There are three (3) classes of sexual assault charges:

  • Aggravated Felonious Sexual Assault
  • Felonious Sexual Assault
  • Sexual Assault
