Can You Get Your License Reinstated?

After an arrest, if you are charged with DWI or DUI in New Hampshire, you will automatically have your driver’s license suspended, whether or not you plead guilty. You will have a very short amount of time to schedule a hearing at the Department of Motor Vehicles to argue for the return of your driver’s license. In many cases, this will be your lawyer’s first opportunity to review the evidence against you and start preparing evidence on your behalf for the criminal case to follow.

Depending upon your circumstances such as whether this is your first DWI or DUI, or you were significantly over the .08 BAC limit, you can have your driver’s license suspended anywhere from six months to two years.

The Penalties Pile Up

In addition to the penalties imposed in any criminal court, the Department of Motor Vehicles will likely attempt to impose a period of license suspension through an administrative license suspension (ALS). If a driver suspected of DWI/DUI (Drunk Driving) refuses to take a breath test, or produces a breath test of greater than .08 (.02 for someone under 21 years of age), the Department of Motor Vehicles will suspend that person’s license for six (6) months for a first offense and two (2) years for a subsequent offense.
