When do I need a Divorce or a Family Law Attorney?
Hiring an attorney is a personal choice, not a requirement in the New Hampshire Family Court System. The Family Court System is equipped to provide filing forms, proposed decrees and parenting plans for unrepresented (“pro se”) parties to represent themselves through their divorce, child support or parenting plan matter.

How long does the process take?
Due to the current judicial resources and backlog of cases, a contested (non agreement) divorce or parenting plan dispute can take between 18 and 24 months. If the parties, on their own or through attorneys, have reached an agreement, the process can be completed within 90 days of the court filing.
Should I consider mediation in my divorce or family law case?
Mediation is a non-binding process whereby the parties in a family law dispute attempt to settle their areas of disagreement. Mediation is mandatory through the Family Court Mediation System following the commencement of a divorce or parenting petition. The mediator cannot offer legal advice nor can he or she force the parties to enter into an agreement.
Mediation can also be conducted via private mediation which is generally performed by an experienced family law attorney. How is child support calculated in my family law case?
Child support is calculated according to New Hampshire RSA 458-C. For a traditional parenting schedule (one party has primary residential responsibility), the non residential (visitation parent) pays child support according to a child support formula. If I fear for my safety and for the safety of my children, what should I do?
New Hampshire RSA 173-B governs situations involving domestic violence. If you or a family member fears for your safety, you should immediately contact your local police department by telephone or in person.
