Assault

Under New Hampshire law, there are many different kinds of assault allegations.

First Degree Assault

The first and most serious is first degree assault.  First degree assault is a class A felony.  A person commits this crime when he purposely causes serious bodily injury to another person, purposely or knowingly causes bodily injury to another person with a deadly weapon.

Second Degree Assault

Second degree assault is a class B felony.  A person most commonly commits this crime when he knowingly or recklessly causes bodily injury to another person, recklessly causes bodily injury to another with a deadly weapon.

Simple Assault

Simple assault is usually charged as a class A misdemeanor.  A person commits this crime when he purposely or knowingly causes bodily injury or unprivileged physical contact to another person, recklessly causes bodily injury to another person, or negligently causes bodily injury to another person with a deadly weapon.

Reckless Conduct

Reckless conduct can either be a misdemeanor or a felony.  It is a misdemeanor if a person recklessly engages in conduct which places or may place another person in danger of serious bodily injury.  It is a felony if the person uses a deadly weapon during the offense.

Criminal Threatening

Criminal threatening can either be a misdemeanor or a felony.  It is most generally understood as threatening harm to someone.  A person commits this crime if he purposely places or attempts to place another person in fear of imminent bodily injury or physical conduct, or threatens to commit a crime against another person with a purpose to coerce or terrorize that person.  Criminal threatening is a misdemeanor, unless the person uses a deadly weapon.  Then it is a class B felony.
