Child Pornography

Another computer-related crime is possession and/or distribution of child pornography.  Police and prosecutors are pursuing these cases more aggressively in recent years, and they are seeking higher jail and prison sentences for people convicted of this crime.

Possession of Child Pornography

A person commits the crime of possession of child pornography if he knowingly procures, possesses, or controls any visual representation of a child engaging in sexually explicit conduct.  A person also commits this crime if he brings, or causes to be brought, into this state any visual representation of a child engaging in sexually explicit conduct.

Possession of child pornography is a class A felony.  A second offense for this crime is punishable by up to 10 to 20 years at the New Hampshire State Prison.

Distribution of Child Pornography

A person commits the crime of distribution of child pornography if he knowingly sells, exchanges, transfers, or possesses with the intent to do any of those things any visual representation of a child engaged in sexually explicit conduct.  A person also commits this crime if he knowingly publishes, exhibits, or otherwise makes available any visual representation of a child engaged in sexually explicit conduct.

A person convicted of distribution of child pornography may be sentenced to the New Hampshire State Prison for 10 to 20 years for a first offense and 15 to 30 years for a second offense.
