June 26, 2018 – DWI and ALS Dropped – No License Loss for Defendant

Defendant charged with DWI in Hillsborough District Court. State becomes convinced of significant problems proving impairment in the case and agrees to drop both the DWI and the Administrative License Suspension resulting in no license loss for defendant. Defendant pleads to possession of marijuana (violation) and pays $124.00 fine.

June 21, 2018 – Jury Returns Not Guilty on Operating Under the Influence 2 nd Offense

Defendant charged with Operating Under the Influence 2 nd Offense in Lowell District Court. Defendant facing a lifetime license loss of Commercial Drivers License if convicted. Commonwealth produces evidence that defendant crashed into two parked cars after failing to negotiate turn. Commonwealth produces evidence that the defendant admitted to drinking alcohol before driving and that he had bloodshot and glassy eyes and swayed while standing. Jury deliberated for twenty minutes and found the defendant Not Guilty.

June 20, 2018 – Defendant Charged with DWI – Not Guilty After Trial

Defendant Charged in Milford District Court with two counts of DWI. On day of trial, State brings another charge of Driving While Intoxicated for attempting to drive after being released on the initial DWI charge. Officer testifies to slurred speech, odor of alcohol and excessive swaying. Attorney Bush submits booking videos which show defendant not swaying and speaking clearly. Judge views booking tapes and finds client Not Guilty of both counts of DWI and Breach of Bail conditions.

June 14, 2018 – Defendant Charged with DWI Under Age of 21

Defendant is charged in Dover District Court with DWI under the age of 21. Attorney Bush, thru negotiations with the State, negotiates a reduction in the charge to Reckless Driving. This reduction avoids a minimum one-year license loss.

June 14, 2018 – Defendant Charged with Multiple Counts of Simple Assault

Defendant charged in Goffstown District Court with multiple counts of Simple Assault. All charges dropped on day of trial.

June 11, 2018 – Defendant Charged with Simple Assault

Defendant charged in Jaffrey Peterborough District Court with Simple Assault. Thru negotiations with the State, all charges dismissed as defendant pays restitution for hospital bills.

May 29, 2018 – Defendant charged with Multiple Counts

Defendant charged with Multiple Counts of Domestic Violence Simple Assault in Derry District Court. All charges are dismissed after negotiating with the State.

May 23, 2018 – Client Charged with Operating After Suspension

Client charged in Manchester District Court with Operating After Suspension. The suspension was a result of a DWI which mandates a 7-day jail sentence. Defendant pleads to Operating After Suspension (violation) which involves no 7-day sentence.

May 16, 2018 – DWI Reduced to Reckless Driving

Defendant charged with Driving While Intoxicated in Salem District Court. After negotiations with the State, the charge is reduced to Reckless Driving.

May 16, 2018 – Assault Charges Dropped

Defendant charged with Domestic Violence Simple Assault in Nashua District Court. After negotiations with the State and informing them of potential criminal conduct by the victim, all charges are dismissed.

Defendant is charged in Hillsborough Superior Court Southern District with Felony Possession of a Controlled Drug. Through negotiations with the State, Felony is reduced to a Misdemeanor with a suspended sentence.

April 20, 2018 – Defendant is Charged with DWI – ALS Rescinded

At Administrative License Suspension hearing, the hearings examiner rescinds the Administrative License Suspension as he agrees with Attorney Bush that the respondent’s conduct did not constitute a refusal.

April 19, 2018 – Defendant Charged with Driving While Intoxicated

Defendant charged in Nashua District Court with Driving While Intoxicated. Through extensive negotiations with the State, Attorney Bush is able to negotiate a reduced charge of Reckless Driving. The defendant avoids an SR-22 as well as the requirements of an alcohol class and a first offense conviction.

April 16, 2018 – Defendant Avoids Incarceration

Defendant charged in Hillsborough Superior Court with multiple felonies out of a domestic violence incident. Client avoids incarceration and suspended sentence is imposed provided the defendant complete a batterers intervention program.

April 13, 2018 – Defendant Avoids Criminal Conviction and Registration as a Sex Offender

Defendant charged in Derry District Court with Soliciting a Prostitute, a Class A Misdemeanor which would require registration as a sex offender. Through negotiations with the State, the defendant avoids criminal conviction and registration by pleading to a violation level disorderly conduct charges.

April 12, 2018 – Domestic Violence/Simple Assault Charges Dropped

Defendant charged with Domestic Violence/Simple Assault in Nashua District Court. Through plea negotiations with the State, all charges against the defendant are dropped provided that the defendant engage in treatment.

March 30, 2018 – Felony Charges Dropped

Defendant charged in Hillsborough Superior Court North with Felony Possession of a Controlled Drug. Thru negotiations with the Hillsborough County Attorney’s Office, Attorney Bush negotiates a dismissal of the felony charge. The defendant pleads to a related misdemeanor charge.

March 27, 2018 – Felony Charges Dropped

Client charged with Possession of a Controlled Drug (Felony) in Hillsborough Superior Court. After negotiations with the State, the felony charge is dropped. Defendant pleads guilty to a misdemeanor related offense.

March 26, 2018 – Simple Assault Charges Dropped

Client charged with Simple Assault in Jaffrey District Court. After negotiations with the State all charges are dropped.

March 22, 2018 – Felony Reckless Conduct Charges Dropped

Defendant is charged with Felony Reckless Conduct in Hillsborough Superior Court after his gun discharged a round through the wall into an adjoining condominium wall. State believes gun was intentionally discharged into wall. It is revealed at Settlement Conference that the particular model handgun has a defective trigger mechanism which allows handgun to discharge accidentally. All charges are subsequently dropped.

March 15, 2018 – Administrative License Suspension

Defendant charged by police with DWI and refusing to take the breathalyzer. Attorney Bush wins the administrative hearing by arguing that the actions of the defendant did not constitute a refusal.

March 14, 2018 – NH Driver Charged with Operating Under the Influence

Attorney Bush is able to negotiate a Continued Without A Finding (C.W.O.F) in Ayer District Court which allows the defendant to remain driving in New Hampshire.

March 9, 2018 – Defendant Charged with Possession with Intent to Sell

Through negotiations with the State in Rockingham Superior Court, the Defendant is placed in the Rockingham County Diversion Program. This disposition not only avoids a felony conviction, but avoids all criminal charges provided the defendant complies with the program.

March 7, 2018 – Defendant Charged with Aggravated DWI

After negotiations with the prosecutor in Nashua District Court, Attorney Bush gets the Aggravated DWI charge reduced to a DWI which saves the defendant jail time and significantly reduced the license loss.

February 27, 2018 – Defendant charged with Conduct After an Accident

After negotiations between Attorney Bush and the prosecution, the Conduct After Accident Charge was dismissed in Seabrook District Court. This saved the defendant a criminal conviction and the requirement of a SR-22 on his insurance.

February 27, 2018 – Domestic Violence Petition Dismissed

Domestic Violence petition filed against respondent in Nashua District Court was dismissed by the court.

February 21, 2018 – Misdemeanor Charges Reduced to Violations

Defendant is charged in Manchester District Court with two misdemeanors, Resisting Arrest and Disorderly Conduct. Attorney Bush negotiates a disposition where the defendant pleads to a violation level Resisting Arrest thus avoiding a criminal record.

February 21, 2018 – Simple Assault Charges Dismissed

Client charged with Simple Assault in Nashua District Court. Attorney Bush successfully negotiates a dismissal of all charges.

February 15, 2018 – Domestic Violence Charges Dismissed

Defendant is charged with Domestic Violence related Simple Assault in Nashua District Court. Attorney Bush is able to negotiate a dismissal of all charges.

February 1, 2018 – Habitual Offender Status Avoided

Defendant charged with Negligent Driving (2nd Offense) in Nashua District Court. If convicted, the Defendant would be certified as an Habitual Offender. Attorney Bush negotiates a disposition with prosecutor whereby defendant pleads to Disorderly Conduct which takes matter out of motor vehicle code.

January 31, 2018 – Restraining Order Dismissed

Attorney Bush represents respondent in Milford District Court in Domestic Violence Restraining Order hearing. After hearing, Judge Crocker dismisses restraining order against respondent.

January 25, 2018 – Felony Sale of Drug Charges Reduced to Misdemeanor

Defendant is charged with Sale of a Controlled Drug in Hillsborough Superior Court. After negotiating with the State, Attorney Bush obtains a resolution where the Felony charges are reduced to a misdemeanor and the defendant receives no jail time.

January 25, 2018 – Defendant Charged with Driving While Intoxicated 2nd Offense.

Defendant faces a total of 5 years license loss and 5 days in jail in Nashua District Court. After negotiation with prosecution, Defendant pleads to DWI 1st and receives a 90-day license loss with no jail time. State also withdraws request for Administrative License Suspension.

January 17, 2018 – Criminal Trespass Charges Dropped

Attorney Bush successfully negotiates a resolution in Nashua District Court where all charges in Criminal Trespass case are dropped provided that the defendant pay restitution.

January 16, 2018 – All Domestic Violence Charges Dropped

Defendant is charged in Derry District Court with two counts of Domestic Violence Simple Assault, Reckless Conduct and Obstructing Report of a Crime. After Attorney Bush negotiates with the State all charges are dropped provided the defendant complete community service.

January 11, 2018 – Client Charged with Unemployment Compensation Fraud

Client is charged in Hillsborough Superior Court with Unemployment Compensation Fraud by the Attorney General’s Office. Attorney General insists that client serve jail time. After exhaustive negotiations with State, defendant agrees to pay restitution but serves no jail time.

January 10, 2018 – Operating After Suspension Charges Reduced

Defendant charged with Operating After Suspension in Nashua District Court, a major motor vehicle violation. After negotiations with police, charges are reduced to Operating Without a Valid License.

January 8, 2018 – Marijuana and Open Container Charges Dropped

Client charged with possession of marijuana and open container in Lebanon District Court. Attorney Bush negotiates dismissal of charges provided the defendant enroll and complete a diversion program.

January 5, 2018 – Felony Domestic Violence Charges Dropped

Client facing Felony Level Domestic Relation Charges in Hillsborough South Superior Court. Attorney Bush negotiates with State which ultimately leads to all charges being dropped.

Client charged in Keene District Court with Operating After Suspension which is a major motor vehicle offense. After negotiations with the State, the charge is reduced to Operating Without A Valid License which is a minor motor vehicle offense under the statute.

Client charged in Nashua District Court with Simple Assault. After negotiating with the State all charges were dismissed.

December 5, 2017 – DWI 2nd Charge Reduced to Reckless Driving

Client charged in Derry District Court with DWI 2nd Offense. Client facing a total license loss of 5 years on 2nd offense as 3-year on the criminal charge running consecutive to 2 years for the refusal. Attorney Bush negotiates a reduction in the DWI 2nd Offense to a Reckless Driving with a 60-day minimum mandatory license loss. State also agrees to withdraw Administrative License Suspension request of 2 years.

Client charged with Operating While Certified as an Habitual Offender in Cheshire County Superior Court. Attorney Bush negotiates a reduction in the sentence from 12 months stand committed to 14 days in the Cheshire County House of Corrections.

September 1, 2017 – Felony Charges Dropped

Defendant originally charged in Hillsborough County Superior Court with Felony Aggravated Driving While Intoxicated as a result of an accident which resulted in the death of a motorcyclist. Defendant subsequently charged with Felony Conduct After Accident, Possession of Marijuana and Endangering the Welfare of a Child. Both Felonies and all of the above charges were dismissed. The defendant pled guilty to Misdemeanor Reckless Conduct and received a suspended sentence and no license loss.

March 30, 2017 – Neighbor seeks stalking charge against defendant in Nashua District Court. Attorney Bush successfully argued for dismissal after hearing by Court (Leary J) as petitioner failed to meet her burden under stalking statute.

March 29, 2017 – Defendant charged in Nashua District Court with Felony theft. After negotiations with the State, Felony is nol prossed and the defendant pled to a reduced charge of a misdemeanor with no jail time.

March 28, 2017 – Defendant charged with Domestic Violence related Criminal Threatening and Simple Assault in Hampton District Court. Both charges dismissed on day of trial.

March 22, 2017 – Defendant charged with DWI 2 nd offense in Nashua District Court

With a prior offense within the past 2 years, defendant was eligible for a minimum mandatory sentence of 30 days in jail. The defendant submitted to a breath test with a result of .15. Attorney Bush was able to negotiate the case to a DWI 1 st offense and the defendant received no jail time.

March 9, 2017 – Felony Drug and Reckless Driving Charges Dropped

Client charged in Nashua District Court with Felony Possession of a Controlled Drug, Misdemeanor Possession of a Controlled Drug and Reckless Driving. November 21, 2016 – Client is charged in Newburyport District Court with Multiple Felonies, Breaking and Entering, Receiving Stolen Property and Malicious Destruction of Property. After negotiations with the District Attorney, Attorney Bush is able to have all charges dropped against the client.

November 14, 2016 – Client is charged with Driving While Intoxicated. Attorney Bush wins Administrative License Hearing as Hearings Examiner finds State failed to prove by a preponderance of evidence that officer properly informed respondent of his Administrative License Suspension Rights.

November 10, 2016 – Client charged with Reckless Driving in Nashua District Court. After negotiation with Nashua prosecutor the case was reduced to a Moving Violation with a $72.00 fine.

October 27, 2016 – Client charged in Nashua District Court with Aggravated DWI. After negotiating with the Nashua Police Department, the charge was reduced to a DWI.

October 27, 2016 – Client charged in Nashua District Court with Felon in Possession of a Firearm. After negotiations with the prosecutor, Attorney Bush had the case reduced to a Misdemeanor with no jail time.

October 26, 2016 – Client charged in Wrentham District Court with Malicious Destruction of Property, Disorderly Conduct and Resisting Arrest. Attorney Bush gets the Commonwealth to agree to drop Malicious Destruction of Property and Disorderly Conduct. The Resisting Arrest charge gets continued without a finding for 60 days.

September 2016 – Client charged in Rockingham Superior Court with Felonious Sexual Assault. After negotiation with the County Attorney’s Office, all sexual assault charges are dropped. Attorney Bush’s client agrees to plead guilty to Simple Assault.
